Semiremolques El Paisano SA de CV, also referred to in this document as “Paisano Trailers”, warrants the products manufactured at its factory, whether sold through an authorized Paisano Trailers dealer or directly to the final end user, under the following terms and conditions.

1.1 Manufacturer’s Warranty

Paisano Trailers warrants to the original purchaser that the trailer shall be free from defects in materials and workmanship for a period of one (1) year from the Date of First Purchase, provided that all conditions of this Limited Warranty are met.

Original Owner

The Original Owner is defined as the first retail purchaser or lessee of the Paisano Trailer, whether purchased directly from Paisano Trailers or through an authorized dealer, who takes delivery of the trailer on its Date of First Purchase.

This Limited Warranty is non-transferable and applies only to the Original Owner.

Warranty Registration

Warranty registration is recommended to facilitate service; however, failure to register the trailer within fifteen (15) days of purchase shall not invalidate this Limited Warranty, provided that the Original Owner presents a valid proof of purchase, such as an invoice or sales receipt.

1.2 Warranty Coverage

This Limited Warranty covers defects in materials and workmanship affecting the following structural components:

Main frame
Factory welds
Crossmembers
Ramps
Railings
Other non-wearing structural components

Coverage applies for a period of one (1) year from the Date of First Purchase.

All repairs or services must receive prior written approval from Paisano Trailers before any expenses will be considered for reimbursement under this Limited Warranty.

Paisano Trailers shall not be responsible for repairs or services performed without prior written authorization.

1.3 Third-Party Components

Components manufactured by third parties, including but not limited to:

Axles
Suspension components
Tires
Wheels
Lights
Brakes
Jacks
Hydraulic cylinders
Electrical components

are covered exclusively by the warranties provided by their respective manufacturers.

Paisano Trailers will provide reasonable assistance to the customer in processing warranty claims with such manufacturers.

1.4 What Is Not Covered

This Limited Warranty does not cover:

Normal Wear and Maintenance Items

Including, but not limited to:

Paint and finish
Bearings
Brake linings
Brake shoes and pads
Hoses
Flooring
Lubricants
Bulbs
Batteries

Lack of Maintenance

Damage resulting from improper maintenance or failure to follow the maintenance procedures described in the Owner’s Manual.

Misuse and Abuse

Damage caused by:

Overloading beyond the trailer’s rated capacity or GVWR
Negligence
Improper operation
Unauthorized modifications or repairs
Rewiring or tampering

Abrasion and Material Wear

Abrasion, impact wear, corrosion, or material loss caused by transporting:

Sand
Gravel
Aggregates
Demolition debris
Other abrasive or corrosive materials

Environmental and Corrosive Conditions

Damage caused by:

Marine environments
Road salts
Fertilizers
Chemicals
Acid rain
Floods
Lightning
Hail
Windstorms
Other acts of God

Accidents and External Events

Damage resulting from:

Collision
Fire
Theft
Riot
Vandalism

Non-OEM or Incorrect Parts

Damage caused by the installation of incorrect tires or non-OEM parts of inferior quality.

1.5 Transportation Costs

Transportation costs to and from Paisano Trailers, an authorized dealer, or an approved repair facility are the responsibility of the trailer owner unless Paisano Trailers, at its sole discretion, agrees in writing to cover all or part of such expenses.

1.6 Warranty Void

This Limited Warranty shall be void if the trailer has been subjected to:

Abuse
Misuse
Negligence
Overloading
Unauthorized alterations or modifications
Repairs performed without prior written authorization

1.7 Limitations of Liability

Paisano Trailers’ sole obligation under this Limited Warranty is limited to the repair or replacement of defective parts, at Paisano Trailers’ option.

Paisano Trailers shall not be liable for incidental, indirect, special, or consequential damages, including but not limited to:

Loss of use
Loss of time
Inconvenience
Commercial loss
Lost profits

Reimbursement for approved repairs shall be limited to labor and material costs deemed reasonable by Paisano Trailers.

1.8 Disclaimer of Other Warranties

This Limited Warranty is provided in lieu of all other warranties, express or implied.

Paisano Trailers disclaims all implied warranties, including but not limited to:

Merchantability
Fitness for a particular purpose

No dealer, distributor, or other person is authorized to modify or extend this Limited Warranty.

Paisano Trailers reserves the right to make design or production changes without any obligation to previously manufactured or sold trailers.

1.9 Dealer and End User Responsibilities

Responsibility for initiating and submitting warranty claims rests with the authorized dealer or the Original Owner, depending on the method of purchase.

2.1 Warranty Claim Process

The Original Owner must notify Paisano Trailers or the authorized dealer within fifteen (15) days after discovering a potential defect.
The trailer must be made available for inspection.
A written estimate and photographic evidence may be required.
Paisano Trailers will review the claim and provide written approval or denial.
Paisano Trailers will make reasonable efforts to respond to complete warranty claims within seven (7) business days.
Defective parts may be required to be shipped prepaid to Paisano Trailers within thirty (30) days of request.
Reimbursement, if approved, will be issued only after the repair has been completed and supporting documentation has been received.

2.2 Governing Law and Jurisdiction

This Limited Warranty shall be governed by and construed in accordance with the applicable laws of the United States of America or the United Mexican States, depending on the jurisdiction in which the warranty claim or dispute is brought.

Any legal action or proceeding arising out of or relating to this Limited Warranty may be brought in any court of competent jurisdiction located within the United States of America or the United Mexican States.

2.3 Geographic Coverage

This Limited Warranty applies to Paisano Trailers normally operated in the United States, Canada, and Mexico.
